Terms and Conditions
Eligibility Criteria
The Outdoor Furniture Grants Program is open Australia-Wide to sports clubs/associations, and education institutions to undertake projects to enhance their outdoor spaces with outdoor furniture from Felton Industries.
In order to be considered, the project must:
- Be delivered by Australian-registered sports clubs/associations, schools and education institutions with an ABN and Australian bank account (unless otherwise agreed by Felton Industries)
- Create opportunities to enhance outdoor spaces within Australia, reflective of customer priorities or in those communities.
- Create opportunities to turn empty spaces into meeting places with outdoor furniture, creating positive outcomes in one or more of the following: sports clubs/associations, and education institutions.
- Be delivered within ten (10) months of participation in the Outdoor Furniture Grants Program being confirmed, with grant funding used by 30 June 2025; and,
- Provide an avenue for promoting an understanding of Felton Industries, our products and our contribution to local communities.
Felton Industries reserves the right to consider projects that do not fall within the above eligibility criteria or to impose additional eligibility criteria for certain categories of projects, where reasonably required.
If Felton Industries chooses to partner with you as a funding or in-kind sponsor, you will be required to enter into a Felton Industries Outdoor Furniture Grant Agreement, which will be tailored to suit your project and outline your obligations in more detail. Some of the standardised obligations will require you to:
- Enter into an Outdoor Furniture Grant Agreement
- Redeem the grant on agreed Felton Industries products to be purchased & installed during the specified funding period (up until 30 June 2025)
- Report on the progress, completion and social impact of the project via an online survey, a link to which is to be provided by Felton Industries
- Acknowledge Felton Industries support publicly.
- Successful applicants agree to be included in various promotional, media, communication and marketing material and will cooperate with Felton Industries in promoting the Outdoor Furniture Grant Agreement.
Application Process
In order to have a proposed project considered by Felton Industries, applicants will be required to complete an Application Form by 29 August 2024, which is available online here.
Felton Industries reserves the right to approach potential applicants at any time.
Before submitting an application we encourage applicants to read and understand the Program Guidelines and these Program Terms and Conditions. All applicants that submit an application agree to be bound by these terms and conditions. These terms and conditions are subject to change over time, however, and may be updated/amended at Felton Industries’ discretion at any time.
Applicants are responsible for ensuring that the information supplied by way of their application is complete and accurate. Felton Industries may ask for clarification or additional information from applicants if we consider it necessary to assess a proposal.
Selection Process - How the grant process is decided
All eligible Outdoor Furniture Grant applications will be assessed by a panel (comprised of representatives from Felton Industries) according to the criteria.
To give your application the best chance of securing a grant, ensure you clearly demonstrate how you meet each criterion.
Where appropriate, Felton Industries will seek to discuss the proposed project in more detail. As part of this process, Felton Industries may require applicants to participate in certain third-party due diligence processes.
By submitting an application and participating in the selection process, applicants consent to Felton Industries using and disclosing the information provided in the course of the application process and, if successful, during or after the grant period for the purposes of conducting the Outdoor Furniture Grants Program.
Decision and Award
If an application is successful:
- A representative of Felton Industries will contact you to provide confirmation of the same and to discuss next steps; and
- The applicant will be required to enter into a legally binding agreement with Felton Industries governing the terms of the applicant’s participation in the Improving Outdoor Furniture Grants Program; and
- The applicant will be required to participate in a launch announcement, which will occur before the end of September 2024 (date to be advised).
Due to caps on funding, however, it is likely that some applicants/applications that satisfy the eligibility criteria may not be invited to participate in the current year’s Outdoor Furniture Grants Program. The final decisions in this regard and the amount of funding to be allocated in each instance (if at all) is at the sole discretion of Felton Industries. While Felton Industries will advise applicants of the outcome of their applications as soon as possible, Felton Industries is under no obligation to enter into correspondence in relation to the decision-making process or the outcomes.
Payment of Grant
The formal Outdoor Furniture Grant Program Agreement will confirm the timing of the credit and the maximum amounts to be awarded by Felton Industries. The grant funds are all-inclusive, and the grant recipient must meet any additional costs associated with the delivery of the project and the receipt of the grant fund from Felton Industries (including any related charges, fees and taxes).
The grant recipient will need to provide evidence that a bank account is held by the grant recipient and that the bank details are accurate and complete.
Grant recipients should seek independent advice as to whether they have a tax liability arising in connection with receipt of grant fund credit.
Use of Grant Funds
The grant fund must be used solely for the approved project as set out in the Outdoor Furniture Grants Program Agreement and be expended by 30 June, 2025. The grant recipient must provide Felton Industries with regular reporting, as specified by Felton Industries from time to time.
If completion of the project/program/ initiative in the manner proposed is no longer possible, the grant recipient must advise Felton Industries as soon as possible so that alternate options can be discussed.
For successful grant applications, Felton Industries will cover partial funding of freight/delivery cost. The remaining freight cost will need to be covered by successful grant applicants.
General Terms and Conditions
Felton Industries may promote the Outdoor Furniture Grants Program from time to time as it deems appropriate. Each grant recipient consents to their name, details of their project and related intellectual property being used in Felton Industries promotional materials and grants to Felton Industries an irrevocable, perpetual, non-exclusive and royalty free licence to use, reproduce, modify, disseminate and publish any such materials for any purpose (and to grant sublicenses in respect of the same).
- Felton Industries makes no express or implied warranty or representation in relation to the Outdoor Furniture Grants Program other than as set out in the Guidelines and these Program Terms and Conditions and, to the maximum extent permitted by law:
- Any liability that Felton Industries may have to any party, whether for negligence, breach of contract or otherwise in respect of the Outdoor Furniture Grants Program is limited to conducting the Outdoor Furniture Grants Program in accordance with the Guidelines and these Program Terms and Conditions; and
- Felton Industries will have no liability whatsoever for any loss of profits or any other incidental, consequential or indirect loss or other consequence in connection with the Outdoor Furniture Grants Program.
Repayment, Variation or Termination of Grant Agreement
Felton Industries may terminate the Grant or Initiative or request the recipient to modify the initiative or require a repayment of the Grant if:
- The Recipient has breached the outlined Terms and Conditions, including if the Recipient has spent the Grant otherwise than in accordance with the Terms and Conditions.
- If Felton Industries determines that the funding criteria has not been met by the Recipient
- The Recipient was ineligible to receive the Grant
- The Recipient has provided false or misleading statements within the Grant Application, or the Grant Application was incomplete or incorrect.
- The Recipient has become bankrupt or insolvent, entered into a scheme of arrangement with creditors, or come under any form of external administration.
- The Recipient has in relation to these Terms and Conditions, breached a law of the Commonwealth, or of a State or Territory
- The Recipient has had a Change in Control or Change in Circumstance that will negatively affect the Recipient’s ability to comply with these Terms or conditions; OR
- The Recipient is otherwise notified in writing by Felton Industries.
The Recipient agrees on receival of a notice of termination or variation to:
- Stop or vary the performance of the Recipient’s obligations and Initiative as specified in the notice;
- Repay any funds that the Recipient has received from Felton Industries
- Take all Available Steps to Minimise loss resulting from termination or reduction
The Recipient will not be entitled to any compensation whatsoever as a consequence of a termination or variation of the Initiative or Grant.
